Court\'s history of Republic of Azerbaijan begins since 1918 with the establishment of the Azerbaijan Democratic Republic. Ministry of Justice was established on May 28, and Khalil bey Khasmammadov was appointed as first Minister of Justice. By the decision of the Council of Ministers of 01 October 1918, the activity of District Court in Baku and the Prosecutor\'s Office within it was restored and the Statute of Judicial Chamber was approved on 14 November.
In April 27-28, 1920, after the Democratic Republic of Azerbaijan was occupied by the Russian XI Red Army by the decision of the Revolutionary Committee of Azerbaijan dated on May 13, 1920, the People\'s Commissariat of Justice was created by the cancellation of the entire judicial system. However, the Commissioner was abolished in 1930 and its powers were given to the Supreme Court, Central Executive Committee and other bodies. People\'s Commissariat of Justice was reorganized in 1933, the Justice Commissioner has the authority of the Public Prosecutor at the same time and his deputy - the chairman the Supreme Court. 
By decision of the Presidium of the Supreme Soviet of Azerbaijan SSR, dated December 7, 1959, the Ministry of Justice was annulled again and management and control of all activities of the judicial authorities, conducting of judicial statistics was entrusted to the Supreme Court. However, by the decision of the Presidium of the Supreme Soviet of Azerbaijan SSR dated October 27, 1970, the Ministry of Justice was re-established and thus began a new stage in the history of the judiciary.
According to the Constitution of the Republic of Azerbaijan after Azerbaijan regained its independence the judicial power in the country is implemented by the Constitutional Court, the Supreme Court, and Courts of Appeal of the Republic of Azerbaijan, common and specialized courts. Judicial power is realized in civil and criminal court proceedings and by other means as specified by law.
Three stage judicial system of the republic - first instance, courts of appeal and cassation instance has been created. This system entered a new stage by the modernization of the judicial system in the Republic of Azerbaijan and by Decree On amendments and additions to some legislative acts of the Republic of Azerbaijan on application of the Law of Republic of Azerbaijan,  signed by the President of the Republic of Azerbaijan dated on January 19, 2006
